Trade Day Rules

1. Trade Days reserves the right to refuse admission to any vendor.

2. All vendors must check in at the information booth before occupying their space. Booth fees are to be paid in full BEFORE vendors can occupy their booth. NO EXCEPTIONS!!

3. Anyone selling, swapping, trading, or otherwise engaging in business on the premises must have a booth receipt. Booth receipts are issued for the sole purpose of admitting said vendor.

4. There will be NO refunds or credits.

5. Subleasing of lots is absolutely prohibited.

6. Each Vendor is required by Texas State Law to have a Texas Sales Tax permit and be responsible to report their own Sales Tax. The City of New Boston tax rate is 8.25%. Sales tax information is available by calling (800) 252-5555.

7. Trade Days shall designate selling areas and each vendor shall sell only within the confines of his/her area. NO hawking is permitted at any time.

8. Trade Days reserves the right to restrict the sale or display of any item that is deemed inappropriate, in order to maintain a family atmosphere. Absolutely NO GUNS. NO SILLY STRING!

9. A vendor parking pass must be shown when entering the grounds and kept visible when parked on the grounds. One parking pass is required for each vehicle.

10. Motorcycles, bicycles, skates, skateboards, scooters, & horses are not permitted on the grounds during the sale. Golf carts & three or four wheelers are prohibited except for authorized personnel.

11. A speed limit of 5 mph throughout the grounds will be strictly enforced.

12. Anything left on the premises is done so entirely at the risk of the vendor or owner.

13. Trade Days assumes no liability for any disputes among dealers and/or customers or for any damage to persons or property. Trade Days will tolerate NO arguments or profanity between vendors and/or customers.

14. Vendors are responsible for keeping their booth clean. There will be trash receptacles provided throughout the premises. No trash is to be left in vendors' booth at closing.

15. Trade Days is not responsible for any damages, lost or stolen personal property or damage to vehicles while on premises.

16.The public consumption, selling, dispensing, or donating of alcoholic beverages of any kind is not permitted on the grounds.

17. Loud music, amplifiers, or any other loud noises that management deems inappropriate will not be allowed.

18. Any advertisement may not be placed on buildings, posts, or any other personal property of Trade Days.

19. Small animals such as puppies, kittens, birds, etc. will be allowed to be sold. Must be approved by Trade Days. All booths will be open booths and no animals will be allowed under the pavilion.

20. parents or guardians are responsible for minor children brought onto the premises.

21. Trade Days recommends use of 12/3(Heavy Duty) extension cords to hook up electricity. Anyone causing damage to the electrical system will be charged a minimum of $25 for damages.

22. Renewal of all lots for the following month may be made during the show at the Information Booth. Lots left un-renewed become available at closing time Saturday. Any vendor paying 3 months at a time, will receive an extra month free. Booths not renewed prior to closing on Sunday of Trade Days may be rented to other vendors. YOU MUST PAY FOR YOUR SPACE IN ORDER TO RESERVE IT!

23. Trade Days reserves the right to cancel the show for any month.

24. Trade Days assumes NO liability for the sale of counterfeit merchandise.

25. No venomous and/or toxic reptiles, insects, spiders, or animals shall be sold or allowed on the Trade Days Trade Day grounds, including snakes of any kind.

26. These rules & regulations are subject to change at any time without notice.

27. A maximum of 4 booths may be rented by any one vendor for any given month.

28. Vendors may set up during the following times: Friday beginning at noon, Saturday 7:00 – 8:30 am and Sunday 7:00-8:30 am. Vendors must be set up by 8:30 am and must remain until 4 pm. This is for the safety of our customers and vendors. Please unload your vehicle and move your vehicle, before setting up your booth. This will prevent congestion in the isles.

29. FOOD & DRINK CONCESSIONS:

a. A food vendor is described as; a seller of food as described in section 229.162 on page 8 number 29 of the Texas Dept of Health Food Establishment Rules-"Food-A raw, cooked, or processed edible substance, ice, beverage, or ingredient used or intended for use or for sale in whole or part for human consumption." (A seller of repackaged items (cookies, etc.) and uncut produce (tomatoes) is not considered a food vendor per section 229.162,33b.

b. Food items and drinks must be sold from a concession trailer that meets the State of Texas Health Dept standards. The sale of any food item requires Trade Days consent.

c. Must have on display in concession stand and provide a current copy of their Bowie County Texas Food Establishment Health Permit to the Trade Days office.

d. Must provide the Trade Days with a Certificate of Liability Insurance naming City of New Boston as additional insured and must have a Texas Food Manager Certification.

e. Concessions are allowed to set up as early as noon on FRIDAY prior to the show, as long as it does not interfere with anyone who may have the T & P Park rented.

f. YOU MUST MAINTAIN A CLEAN & SAFE FOOD CONCESSION AT ALL TIMES!
